This course offers a comprehensive overview of OSHA regulations, focusing on the division of jurisdiction between federal and state OSHA plans, multi-employer worksite policies, the General Duty Clause, and the rights and protections afforded to workers. Participants will explore the nuances of OSHA’s enforcement authority, responsibilities of employers on multi-employer worksites, and the legal framework for whistleblower protections.

Key topics include:

•  Federal & State Plan OSHA Jurisdiction: Understanding the scope of OSHA’s authority, the differences between federal and state-run OSHA programs, and how jurisdiction is determined.

•   Multi-employer Worksites: Examining OSHA’s policies for worksites with multiple employers.

•   General Duty Clause: Analyzing the requirements under Section 5(a)(1) of the OSH Act, which mandates employers to provide a workplace free from recognized hazards likely to cause death or serious harm.

•   Worker Rights and Whistleblower Protection: Highlighting the rights of workers to a safe workplace, the process for filing complaints, and protections against retaliation for reporting unsafe conditions or violations.

•  Current Issues: Discussing emerging trends, regulatory updates, and challenges in workplace safety and health, including new standards, enforcement priorities, and industry-specific concerns.
